Liability for Pedestrian Accidents
In Ontario, when a pedestrian or cyclist is struck by a motor vehicle the driver of the vehicle is presumed to be at fault. This presumption of negligence, however, can be rebutted by the driver and/or by their insurance company and their legal team. In serious pedestrian accident cases, such as fatal accidents or other catastrophic injury cases, insurance companies and their lawyers often fight vigorously to contest fault or liability. Where the pedestrian is killed or catastrophically impaired, the victim is unable to provide any account of the accident details. This gives opportunity for the insurance companies to search for facts or circumstances that permit them to blame the pedestrian. In all serious pedestrian accident cases, it is important to retain an experienced injury lawyer early to preserve your rights. A lawyer will often be able to investigate the circumstances of the accident early and appropriately respond to any attempts by the insurance company to blame the accident on the victim.
