owner of a dog liable for damages resulting from a bite or attack by
the dog on another person or domestic animal. Where
there is more than one owner of a dog that bites in Ontario, the law makes all owners jointly and severally
liable for the damages caused by the dog.
It is significant that in Ontario, the liability of the dog owner does not depend upon knowledge of the propensity of the dog or fault or negligence on the part of the owner. An important exception to liability is created where a dog bites a person that is on the premises committing or intending to commit a criminal act, "unless the keeping of the dog on the premises was unreasonable for the purpose of the protection of persons or property." R.S.O. 1990, c. D.16, s. 3 (2). Under the Dog Owners Liability Act, the owners of a dog that bites are strictly liable. |

Under Ontario's dog bite law, the liability of the owner does not depend upon knowledge of the propensity of the dog. In addition, the dog owner will be liable for the damages caused by their dog, irrespective of the fault or negligence on the part of the owner. As such, even if the dog behaved out of character by attacking, the owner will still be liable for the injuries caused by the dog.
