First and foremost we offer our sincere condolences to the family and friends of the the men who were killed in this highway 404 head-on collision. This will, no doubt, be a very difficult time for all those affected by the loss of their loved one.
This fatal highway 404 car accident is under investigation by police. According to early reports, this accident involved a Dodge Neon that collided with a Honda Accord in the northbound lanes of Highway 404, shortly before 6 am. The Neon was driven by a 25-year-old man from Markham, and it was apparently travelling south in the northbound lanes when it collided with an Accord driven by a 57-year old man from Unionville.
It was not immediately known why the Neon was in the wrong lanes on highway 404, and police continue their investigation. From a civil negligence view, it appears that the vehicle travelling on the wrong side of highway 404 was almost certainly negligent and clearly should not have been there. The family of the other driver involved in this tragic head-on collision may be able to advance a wrongful death claim for their losses. In Ontario, when a person is killed in a car accident as a result of someone else's negligence, the immediate family members will be able to advance a wrongful death claim. Wrongful death compensation can include claims for the loss of guidance, care, companionship and services of their loved one.
