Injuries involving infants and children are among the most tragic of Ontario personal injury and medical malpractice cases. The labor and delivery of a child is supposed to be a joyous occasion. Hospitals, nurses and physicians are required to monitor, detect, and timely treat conditions that threaten the mother or child - both are patients. Signs of fetal distress are supposed to be monitored and, where necessary, intervention is supposed to occur. This situation could lead to a baby not getting sufficient oxygen and blood flow to their brain, which could cause cerebral palsy.
Birth injuries can also occurr when medical providers do not timely or appropriately respond to an obstetric emergency. Some examples of this include, placenta previa and placental abruption. These emergecy situations can lead to serious injury or death if not treated appropriately.
