Ontario Injury Lawyers Hope that Increased Penalties for Distracted Driving Will Help Save Lives9/2/2015 As an Ontario personal injury law firm, we often meet individuals and families that are victims of serious accidents caused by distracted driving. There is no question that distracted driving is a major factor in the severity of many crashes on Ontario roads and highways. In our experience, distracted driving accidents often result in more severe collisions and greater injuries. This is often because the distracted driver takes no evasive action to avoid or mitigate the impact. As such, rear-end crashes can be at higher speeds without any braking before impact. Similarly, we have seen pedestrians mowed down by cars in clear daylight while walking in crosswalks. These kinds of accidents occur because the driver was texting and not looking at the road ahead. These Toronto and Ontario distracted driving accidents can are entirely preventable. Although it has been illegal for drivers in Ontario to talk, text, type, dial or email using hand-held cell phones and other hand-held devices, the accidents from distracted driving remain prevalent. In September 2015, the penalties for distracted driving in Ontario have increased significantly, and we sincerely hope that this will help reduce distracted driving accidents. As of September 1, 2015, a driver that is convicted of distracted driving, will face a fine of $490, and as high as $1,000; and three demerit points. If you or a loved one has been injured as a result of a distracted driving accident in Ontario, you may be entitled to compensation for your losses. As a dedicated personal injury lawyer serving Toronto, York Region and the GTA, we often represent pedestrians that have been seriously injured as a result of being struck by a motor vehicle. Pedestrian accidents in Toronto and the GTA often result in critical injuries and, often, these accidents can be fatal. Pedestrian accidents account for a significant number of brain injuries and fractures and broken bones. In our experience, more pedestrian accidents occur in Toronto during the late fall and winter months. Likely, this is because of less daylight, and weather factors that reduce visibility. During colder months, pedestrians also tend to wear darker clothing, which also makes pedestrians less visible to drivers. For drivers, it is important to stay aware and always expect pedestrians, particularly in urban areas and near intersections. People walking can also do things to improve their safety, such as wearing bright or reflective clothing, and try to make eye contact with drivers before crossing the street. It is important that pedestrians not simply assume that driver's have seen them and will stop. Due to the severity of injuries following a Toronto pedestrian accident, it is common to be off work and in need of assistance for an extended period of time. Financial hardship can present additional challenges and difficulties on top of your efforts to get better and heal.
