Driving without insurance in Ontario is against the law and could have serious consequences if you are involved in an accident. In addition to not having insurance coverage to protect you from a claim for loss or injury, an uninsured driver also risks no means to recover in the event that they are injured. Pursuant to s. 267.6 (1) of the Insurance Act, any person operating a motor vehicle in contravention of s. 2(1) of the Compulsory Automobile Insurance Act (i.e. having insurance when operating a motor vehicle), forfeits all right to pursue a claim for injuries or losses. The language of s. 267.6 (1), provides as follows: "Despite any other Act, a person is not entitled in an action in Ontario to recover any loss or damage from bodily injury or death arising directly or indirectly from the use or operation of an automobile." This section does not contemplate fault, it is a total bar to bring an action to recover for your injury or loss. An exception exists in the situation where a driver is operating another person's vehicle without knowledge that it was not insured. The test is one of reasonableness; that is, that the driver could not have reasonably known the vehicle was uninsured. Protect yourself and others while driving by making sure you have valid insurance coverage at all times. If you were injured due to a driver without insurance you still have rights to claim for your injuries. There is coverage available to innocent victims that are injured due to the fault of an uninsured driver. If you are not sure about your rights because of an insurance coverage issue, contact an experienced lawyer. The injury lawyers at Iacobelli Law Firm are experienced in accident and insurance claims. A motorcyclist was seriously injured as a result of a hit and run accident on Sunday September 29, 2019 in Markham. According to information released by the York Regional Police, there were reports of a serious collision involving a motorcycle on Highway 7, near York Durham Line in Markham. Police learned that a motorcycle had been struck by a Nissan Pathfinder, which fled the scene. If you have been involved in a car accident, you may be wondering whether you need to call the police. You might be feeling ok, and your car is still operable, so you may be wondering whether you need to call police?. Our recommendation is that you do call the police immediately from the accident scene. The police may advise that you can simply exchange information with the other driver and then attend at a police self-reporting collision centre. In those circumstances, try to take photos of the vehicle locations at the scene of the accident, including photographs of property damage to both vehicles. Also, make sure you obtain pertinent information from the other driver and vehicle involved in the accident, including the other vehicle plate number, the driver's full name, driver's license number and insurance information. It is best to take photographs of the driver's license and insurance slip. You should also immediately attend a collision reporting centre to make sure that a police report is authored. You may need this for insurance and in the event that you have any claims for injuries.
Although you may not immediately feel symptoms, it is best to attend at a hospital or doctor's office as a precaution. It is common that injuries, including serious injuries, are not always immediately accompanied by symptoms following an accident. Also, if symptoms develop over the next 24 to 48 hour period, it is again important to seek medical attention. If you have been injured in an accident, and have questions about your rights or steps that you should take, please call us for a Free Consultation. The York Regional Police Road Safety Bureau has announced that it will be using automated licence plate readers mounted on police vehicles in an effort to improve road safety. Some York Regional Police cruisers will have cameras mounted on the rooftops, which will automatically read licence plates on vehicles while the officer is on patrol. According to the York Regional Police, the automated system can read 3,000 to 5,000 licence plates in a 12-hour shift and provides the officer with an alert for infractions such as stolen licence plates, a driver’s licence suspension, expired validation or failure to have insurance.

If you have been injured in an Ontario motorcycle accident, there are important steps you should take to protect your rights. We are experienced motorcycle accident lawyers and also ride and have friends who ride. We understand the passion and joy and that comes with riding a motorcycle, and we are happy to help riders that have been injured in a motorcycle accident. Depending on the severity of the motorcycle accident and injuries sustained, some of these steps may need to be pursued by a legal representative or other person on behalf of the motorcyclist. Here are some of the things to do following a motorcycle accident in Ontario: 1. Call 911 - report the accident to police and request an ambulance if you are injured. 2. If you are not admitted to hospital immediately following your accident, then you should seek medical attention as soon as possible. Not all injuries will be immediately recognized, so it is important to be checked out by a physician. 3. Obtain witness information. In motorcycle accidents, it is especially important to have witness information. This includes the names, addresses, and phone numbers of any and all witnesses. Do not rely on police to collect all the information - we see countless accident investigations where police did not capture the witness details. 4. Take down the other party's information. You should obtain name, and contact information, as well as Driver's License and License Plate number for the involved vehicle. 5. Contact your insurance company and advise them of the accident and that you were injured. Your insurance company will assign a claim number, and send you at a package to be completed. 6. Speak to an experienced motorcycle injury lawyer before completing your application for accident benefits or before giving a statement or other claim related matter. It could be detrimental to your claim to rely on non-legal professionals, such as nurses, physiotherapist, or chiropractors to complete you application for accident benefits. While these clinicians will be more than happy to assist with your insurance forms in order to facilitate funding for treatment, they are not legal professionals and, as such, they may not appreciate the legal ramification that can follow from the statements made in an application for accident benefits We highly recommend that motorcycle injury victims to speak to an experienced Ontario motorcycle accident lawyer about their rights and options following an accident. In a serious accident, a lawyer can assist immediately with obtaining benefits for loss of income, and non-OHIP covered medical expenses. A motorcycle accident lawyer, can also start the process of preserving and collecting the important evidence needed to pursue a claim against the at-fault driver and their insurance company.
