Connect with Andrew Iacobelli on Google+ The Toronto Auto Show is on now, and this year showcases some exciting new vehicles. The past few years have seen the introduction of some interesting innovations in vehicles. In addition to becoming more fuel-efficient, cars are also advancing greatly in terms of safety. In the quest for full autonomous driving, automakers are pioneering some incredible safety technology that will help protect occupants from serious collisions. The Tesla is a remarkable example of how far autonomous driving technology has come already. Given that this is just the beginning, we may see a massive shift in the auto industry over the next decade. Many cars already offer active collision avoidance technology. These vehicles can sense objects ahead and behind, and can automatically apply the brakes to avoid a collision. There are also a number of sensors, warning devices and cameras that are becoming standard across the industry. We expect that over the next decade cars will advance considerably in terms of safety. As vehicles become ever more connected, they will communicate with each other and with traffic control devices, in order to avoid collisions. If you are in the market for a new car, the Toronto auto show is a great place to start looking and comparing vehicles. While car style is appealing, you should also compare available safety features and crash test ratings when selecting a new vehicle. The morning commute today was our first real test of winter driving this season in Toronto and southern Ontario. This morning, I was making the drive from north York Region to North York, and it took me about 2 hours to arrive at my destination. Although the drive was slow, and the roads were snow covered, I was pleased to see that most drivers were cautious and courteous. Although most people drive appropriate for conditions and weather, there inevitably those drivers that insist on driving too fast. When people drive appropriately for the weather conditions, winter driving can actually be quite safe. As a Richmond Hill and Toronto personal injury lawyer, I often see the tragic results when people fail to adjust their speed to the weather conditions. On snow and slush covered roads, driving too fast can result in sudden loss of control. Losing control on a slippery road can result in high impact crashes, and even head on collisions. This winter, please drive safe and adjust your speed to the road conditions. If you or a loved one has been injured due to a car accident because someone else was driving too fast for the road conditions, then you may be entitled to bring a claim for your losses. Accidents involving pedestrians in Toronto and elsewhere in Ontario are, unfortunately, quite common. There is typically a spike in the number of pedestrians struck, during the late fall and winter months. This is in part due to the reduced daylight hours, and also because people tend to wear darker colored clothing during the colder months. Sadly, accidents involving pedestrians and cyclists often result in serious orthopaedic injuries, catastrophic injury or death in the case of a pedestrian fatality accident. Pedestrians Struck by Vehicles in Toronto Have Rights to Compensation In Ontario, hen a pedestrian is struck by a car, there is a presumption of negligence against the driver of the motor vehicle. This reverse onus for pedestrian accidents is created by the Highway Traffic Act. The driver of the motor vehicle that hits a pedestrian in Toronto will have the burden of proving that they were not negligent. As such, we are usually able to obtain fair compensation for pedestrians that are seriously injured by a motor vehicle. These claims are typically paid by the insurance on the vehicle that struck the pedestrian. The victim was a young woman, only 21 years of age. We offer our sincere condolences to the family and friends of the victim.
The collision remains under investigation by the Toronto Police. According to early reports, the pedestrian was crossing the street appropriately when she was struck by a tanker truck that was attempting to make a right turn. To date, there has been an increase in the number of fatal pedestrian accidents in Toronto as compared to last year. There are usually more pedestrian accidents in the late fall and winter months due to the reduced daylight. There is also generally an increase in pedestrian accidents, when it is raining or overcast. In urban areas like Toronto, motorists need to be extra cautious to avoid striking a pedestrian or cyclist. Nonetheless, we see too often that drivers are in a hurry and speed through urban and residential areas. I am always astonished when I see people speeding through urban areas or parking lots. These are places where their is an expectation of high pedestrian traffic, so care should be taken to drive slowly and cautiously. If you were a pedestrian that was injured in a car accident in Ontario, you may be wondering about your rights to compensation. One of the most common questions for pedestrians, is whether to claim against their own insurance or the insurance policy of the car that hit them. The short answer, is both. In Ontario, pedestrians may advance claims for Statutory Accident Benefits and also insurance claims against the at-fault driver for causing the accident, which is paid by that driver's insurance policy. Even if a pedestrian doesn't have their own car and auto insurance, they are still entitled to the Statutory Accident Benefits. If a pedestrian does have a car or is otherwise covered by an auto insurance policy, their statutory accident benefits claim will proceed against that policy. Sometimes, the statutory accident benefits claim will go against the vehicle of the car that caused the accident. This is usually the case where the pedestrian does not have a car and is not otherwise covered by another insurance policy in their household.

Ontario Injury Lawyers Hope that Increased Penalties for Distracted Driving Will Help Save Lives9/2/2015 As an Ontario personal injury law firm, we often meet individuals and families that are victims of serious accidents caused by distracted driving. There is no question that distracted driving is a major factor in the severity of many crashes on Ontario roads and highways. In our experience, distracted driving accidents often result in more severe collisions and greater injuries. This is often because the distracted driver takes no evasive action to avoid or mitigate the impact. As such, rear-end crashes can be at higher speeds without any braking before impact. Similarly, we have seen pedestrians mowed down by cars in clear daylight while walking in crosswalks. These kinds of accidents occur because the driver was texting and not looking at the road ahead. These Toronto and Ontario distracted driving accidents can are entirely preventable. Although it has been illegal for drivers in Ontario to talk, text, type, dial or email using hand-held cell phones and other hand-held devices, the accidents from distracted driving remain prevalent. In September 2015, the penalties for distracted driving in Ontario have increased significantly, and we sincerely hope that this will help reduce distracted driving accidents. As of September 1, 2015, a driver that is convicted of distracted driving, will face a fine of $490, and as high as $1,000; and three demerit points. If you or a loved one has been injured as a result of a distracted driving accident in Ontario, you may be entitled to compensation for your losses.
