With the holiday season here and winter weather in full force, many Canadians will be vacationing in Florida. In addition to escaping the cold winter weather and enjoying the sun and beach, many Canadians will be driving while on vacation in Florida. Most Canadians that travel to Florida either drive their own car or rent a vehicle to get around the state. For the most part, driving in Florida is just like driving in Ontario. The roads are well maintained, and the signage is excellent. Nonetheless, accidents can happen at any time and anywhere. No one plans to be in an accident whether at home or while vacationing in Florida. As a personal injury lawyer licensed to practice law in Ontario and Florida, I have, unfortunately, met many Canadians that have been injured while vacationing in Florida and other other places in the United States. Car accidents that result in injury are always extremely difficult and stressful, but they are even more stressful and challenging when the accident happens while you are away from home. When a resident of Ontario is injured in a Florida accident, there can be additional stress associated with obtaining and paying for medical care. Additionally, you may have questions about which insurance will cover your losses, your pain and suffering, and medical expenses. Insurance laws differ from jurisdiction to jurisdiction. There are different laws for car accidents in Ontario and those that occur in Florida. Nonetheless, if you have a valid Ontario auto insurance policy, you may be able to claim for some of your losses against your Ontario policy. The applicable insurance for your injuries and losses will depend on the nature of the accident, the injuries, and the coverage available for the driver and vehicle that caused the accident. It is important to know your rights before discussing your claim with insurance adjusters. Do not make uninformed decisions that can have major consequences on your right to recover for your losses. If you are a Canadian that has been injured in a Florida accident, call us for a free consultation. We regularly assist Canadians that have been injured in Florida and we may be able to help you too. If your injuries are serious, and you are unable to travel home to Ontario, we can arrange to meet with you at your Florida hospital or home. Car accidents can result in any number of injuries. Some people have immediate and obvious injuries from a car accident, such as broken bones and open wounds. For others, the injuries may be less obvious and, sometimes, the extent of the injury is not known for weeks, months or even years. This is particularly true in the case of soft tissue injuries to the spine. Injuries to the neck, following a car accident, are often diagnosed as a sprain or strain injury or as a Whiplash Associated Disorder. While many of these cervical spine (neck) injuries do resolve with time and physiotherapy, some neck injuries result in irritation of the nerves in the neck or cervical spine. There are nerves that exit the cervical spine (neck) and branch out to muscles that enable the shoulders, arms, hands and fingers to function. These nerves also provide sensation to the skin and muscles. When a nerve root in the cervical spine is irritated through injury, it is often as a result of compression or inflammation. In some instances, a herniated or bulging disc in the spine can also irritate or compress nerves. The impact of the soft-tissue injury on the nerves in the neck can cause the symptoms to radiate along that nerve's pathway into the arm and hand. The individual symptoms of cervical radiculopathy following a car accident will depend on which particular nerve is being affected in the neck. The symptoms may also be referred to as radicular pain. Common Symptoms of Cervical Radiculopathy Following a Car Accident Any condition that injures or irritates the cervical nerve can cause cervical radiculopathy. The most common symptoms of cervical radiculopathy that a person will feel following a Toronto or Ontario car accident include pain, weakness or numbness in their shoulders, arms or hands. The type of pain and intensity can vary from dull aches to severe burning or sharp pain. Another common symptoms is feeling numbness in the extremity, or a sensation of "pins and needles". If you are feeling any of these symptoms following an Ontario car accident, it is important that you discuss this with your doctor. There a number of tests that your doctor can do to assess whether you have a cervical radiculopathy following a car accident. Cervical Radiculopathy Following a Car Accident A cervical radiculopathy following a car accident in Ontario is a serious injury that should not be taken lightly. While there may be many treatment options for cervical radiculopathy, the injury may still be permanent. A cervical radiculopathy can impact on a persons ability to fully engage in their employment, household and recreational pursuits. Connect with Andrew Iacobelli on Google+ Many kids across Ontario will be playing hockey for the first time this fall, and parents will need to buy a lot of equipment to get their little one ready for the game. No piece of equipment is more important than a quality and properly fitted helmet. This year, the Chevrolet free Hockey Helmet Program is back. Through this program, Chevrolet is providing free hockey helmets to parents of 5-year-olds in Canada. This season, children born in 2009 are eligible to receive a free Bauer Hockey helmet.
As a Ontario personal injury lawyer, we frequently assist families that have been struck with tragedy due to a serious accident. Far too often, the injuries we see involve children that have sustained traumatic brain injuries. Helmets are an important piece of equipment for keeping kids safe. Ontario school-age children will be returning to school on Tuesday September 2, 2014. With the resumption of school, there will be many school children walking to and from school. For drivers, it is important to drive with extra caution and attention, particularly during morning and afternoon and in residential and school areas. Keep in mind that young children are unable to fully comprehend and appreciate the risks of crossing streets. Children are also far less able to predict the path of vehicles due to their lack of experience. Although some intersections have crossing guards, the majority of streets around schools are not guarded and children will be crossing independently. Sadly, Toronto and the GTA has had tragedies in recent years as school children have been struck by cars while walking to and from school. Last year, a young girl, Violet Liang, was tragically killed on the first day of school when she was struck by a vehicle. Let's all do our part to make sure the return to school is safe and enjoyable for our children in 2014. Connect with Andrew Iacobelli on Google+ Ontario residents and Canadians travel to the United States frequently for vacations and business. Unfortunately, accidents can happen anywhere and at any time. Many Canadians and Ontario residents are injured each year in car accidents and motorcycle accidents in the United States. A serious car accident is always a stressful and difficult event, and it is even more difficult when a Canadian or Ontario resident is involved in a serious car accident while in the United States. If you are a Canadian injured in a car accident in the United States, you could be facing expensive medical bills for treatment. Although your Ontario automobile insurance provides benefits for medical and rehabilitation expenses, there are limits to the coverage available. In addition, there are many forms that need to be completed and submitted to your auto insurance company. In addition, your Ontario insurance company will ask you to make a choice between Ontario Statutory Accident Benefits and the benefits that would be available under the State law for the jurisdiction where the accident occurred. If you are an Ontario resident with serious injuries due to an accident in the United States, your choice can have major consequences to the amount of insurance coverage available to you. It is important to have an experienced Ontario personal injury lawyer explain the benefits available under Ontario law before making your selection. Cross-border claims involving Canadians injured in United States car accidents can be complex. If you are an Ontario resident, and were injured in a car accident in the United States, there is a chance that the at fault party may be uninsured or underinsured. That is, the other driver's insurance limits may not be sufficient to pay for your claim. Many States have lower minimun insurance requirements for drivers than Ontario. In those situations, you may be able to advance a claim in Ontario, Canada for the uninsured and underinsured benefits that form part of your Ontario motor vehicle insurance policy. Cross border personal injury cases can be complex and you should not delay in consulting a Ontario personal injury lawyer to make sure your rights are fully protected.
